  • Paid Advertising & Performance Marketing

  • Affiliate Marketing & Strategic Partnerships

All Services are designed to improve client visibility, conversions, and overall business performance.

3. Engagement Process

Our engagement process typically includes the following steps:

  1. Consultation: The client shares business goals and service requirements.

  2. Quotation & Agreement: We issue a custom quote outlining service scope, timelines, and deliverables.

  3. Design/Setup Phase: Upon approval, our team executes the agreed service.

  4. Review & Approval: Clients review the completed work.

  5. Payment & Completion: Once approved, payment is made in accordance with the agreed terms.

For marketing services, compensation is performance-based, calculated as 10% of generated sales, unless otherwise stated in writing.

4. Payment Terms

  • Store design and optimization fees are due after project approval but before final transfer.

  • Marketing and advertising fees are commission-based and billed after verifiable results.

  • All payments are processed securely through approved payment gateways.

  • BlueOcean Media reserves the right to suspend services for overdue payments.

5. Affiliate Relationships

BlueOcean Media participates in affiliate programs, including but not limited to Impact Radius, which means we may earn commissions when users make purchases through affiliate links on our website.
All affiliate promotions are disclosed transparently and do not affect the price of products or services promoted.

6. Intellectual Property

All materials, content, and designs created by BlueOcean Media remain the intellectual property of the company until full payment is received.
Upon payment, ownership of completed deliverables (e.g., Shopify stores, design assets) is transferred to the client.

7. Client Responsibilities

Clients are responsible for:

  • Providing accurate information and timely feedback.

  • Maintaining compliance with advertising and eCommerce regulations.

  • Managing their own Shopify accounts, ad budgets, and third-party tools unless otherwise agreed.

Failure to provide required materials or approvals may delay project timelines.

8. Refund Policy

Due to the customized nature of our services, refunds are not issued after project commencement or delivery.
In cases where results are tied to measurable performance (e.g., advertising), payments are contingent upon generated sales, ensuring fairness and accountability.

9. Limitation of Liability

BlueOcean Media shall not be held liable for:

  • Indirect or consequential losses arising from service use.

  • Platform-related issues (e.g., Shopify, Meta Ads, Google Ads).

  • Client mismanagement of stores, campaigns, or third-party integrations.

Our total liability shall not exceed the amount paid for the specific service rendered.

10. Confidentiality

All client information, strategies, and data shared with BlueOcean Media are treated as strictly confidential and used solely for the purpose of executing the agreed services.

11. Termination

Either party may terminate the engagement with written notice if the other party breaches these Terms.
Upon termination, all outstanding balances become immediately due.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States.

13. Policy Updates

BlueOcean Media reserves the right to modify these Terms at any time. Updated versions will be posted on this page with a revised effective date.
